Prima il pagamento del canone con la maturazione del credito dimposta, poi la stipula del contratto di cessione cui fa seguito la comunicazione telematica da parte del cedente e infine l\u2019accettazione del cessionario, sempre via web.<\/p>\n<p>&nbsp;<\/p>\n<p>Occorre innanzitutto verificare la spettanza del bonus: imprese o professionisti con ricavi o compensi 2019 non superiori a 5 milioni di euro (limite non previsto per alberghi e strutture agrituristiche) e \u201cfatturato\u201d di uno o pi\u00f9 dei mesi di marzo, aprile, maggio del 2020, ridotto almeno del 50% rispetto al corrispondente mese del 2019. Per il mese o per i mesi in cui si \u00e8 realizzato il calo, spetta un credito pari al 60% del relativo canone di locazione o affitto (compreso leasing operativo) di immobili non abitativi, misura ridotta al 30% per affitti di azienda o rapporti a prestazioni complesse con almeno un fabbricato a uso non abitativo.<\/p>\n<p>&nbsp;<\/p>\n<p>Il credito di imposta nasce e pu\u00f2 conseguentemente essere ceduto solo successivamente al pagamento del canone del mese interessato, pagamento da effettuare nel 2020. Unica eccezione si ha nella cessione dall\u2019affittuario al locatore: il credito di imposta pu\u00f2 essere trasferito in pagamento di parte del canone senza necessit\u00e0 di un doppio movimento finanziario. Ad esempio, canone di marzo 2020 pari a 5mila euro, credito 60% pari a 3mila euro. L\u2019operazione si perfezione in unica soluzione: l\u2019inquilino versa 2mila euro e contestualmente stipula la cessione del credito compensando il corrispettivo spettante (3mila) con il residuo canone da pagare.<\/p>\n<p>&nbsp;<\/p>\n<p>Nel caso di cessione del credito d\u2019imposta al locatore, il versamento del canone e\u0300 da considerarsi avvenuto contestualmente al momento di efficacia della cessione. Pertanto, e\u0300 possibile fruire del credito d\u2019imposta sulle locazioni cedendolo allo stesso al locatore e pagando il canone per la differenza.<\/p>\n<p>&nbsp;<\/p>\n<p>La cessione del credito (secondo step) va contrattualizzata per iscritto e, preferibilmente, per scambio di corrispondenza onde evitare la registrazione in termine fisso.<\/p>\n<p>&nbsp;<\/p>\n<p>Se il corrispettivo di cessione \u00e8 inferiore al valore nominale, per il cessionario impresa emerge una sopravvenienza attiva tassabile. Nel contratto, il cedente dovr\u00e0 garantire l\u2019esistenza del credito, impegnandosi a effettuare la comunicazione telematica alle Entrate e a fornirne prova al cessionario.<\/p>\n<p>&nbsp;<\/p>\n<p>L\u2019efficacia della cessione nei confronti dell\u2019agenzia delle Entrate \u00e8 subordinata alla comunicazione da parte del cedente (modello approvato il 1\u00b0 luglio 2020).<\/p>\n<p>&nbsp;<\/p>\n<p>A questo punto, al cessionario non resta che completare il percorso comunicando l\u2019accettazione con modalit\u00e0 web alle Entrate. Dal giorno lavorativo successivo si potr\u00e0 compensare il credito nel modello F24 da trasmettere in via telematica senza sottostare ai limiti di importo annuali.<\/p>\n<p>&nbsp;<\/p>\n<p>I cessionari, in caso di controlli, rispondono esclusivamente per l\u2019utilizzo dei crediti d\u2019imposta in modo irregolare o in misura maggiore a quanto ricevuto. L\u2019esistenza dei presupposti per poter beneficiare del credito d\u2019imposta e la corretta determinazione dell\u2019ammontare sono invece verificati in capo al soggetto beneficiario, nei confronti del quale verra\u0300 effettuato il recupero del credito d\u2019imposta nel caso in cui dovesse risultare non spettante.<\/p>\n<p>&nbsp;<\/p>\n<script>\nvar
