Si definiscono infatti quali sono le tolleranze costruttive che non hanno conseguenze sulla commerciabilit\u00e0 dei beni: ora sono applicabili a qualsiasi tipo di conseguenza, anche ai rapporti contrattuali (compravendite, trasferimenti) eliminando possibili contenziosi.<\/p>\n<p>&nbsp;<\/p>\n<p>Il nuovo articolo 34-bis del Dpr 380\/ 2001 prevede la tollerabilit\u00e0 delle diverse dimensioni (altezza, distacchi, cubatura, superficie coperta ed \u00abogni altro parametro delle singole unit\u00e0\u00bb) che rimangano entro il limite del 2% rispetto a quanto previsto dal titolo (licenze, autorizzazioni, concessioni, scia).<\/p>\n<p>&nbsp;<\/p>\n<p>In aggiunta, si introduce il criterio della tolleranza esecutiva, con riguardo alle irregolarit\u00e0 geometriche (ad esempio, muri obliqui), o la diversa collocazione di impianti e opere interne, e infine la modifica alle finiture eseguite durante i lavori per l\u2019attuazione dei titoli abilitativi. Lo spostamento di un bagno, la realizzazione di un tramezzo, la tipologia della finestra, se non violano la disciplina urbanistica ed edilizia e non pregiudicano l\u2019agibilit\u00e0 dell\u2019immobile, vanno considerate mere irregolarit\u00e0 esecutive, e in conseguenza non generano sanzioni.<\/p>\n<p>&nbsp;<\/p>\n<p>L\u2019innovazione non \u00e8 tanto nella pena pecuniaria (in precedenza spesso forfettaria di mille euro), bens\u00ec nella procedura di attestazione dello stato legittimo degli immobili. Si affida infatti a un tecnico abilitato (ingegnere, architetto, geometra, perito) la possibilit\u00e0 di attestare lo \u00abstato legittimo degli immobili\u00bb, con una dichiarazione che pu\u00f2 essere allegata agli atti notarili (trasferimento, costituzione, scioglimento di comunione e di diritti reali).<\/p>\n<p>&nbsp;<\/p>\n<p>Si possono mantenere le distanze legittimamente preesistenti (articolo 2-bis), si pu\u00f2 ricostruire ci\u00f2 che \u00e8 crollato o demolito, se \u00e8 possibile accertarne la preesistente consistenza (articolo 3) e infine si pu\u00f2 ritenere legittima una situazione consolidata che risulti da elementi non strettamente edilizi. In particolare, il nuovo articolo 6, comma 1-bis, definisce lo \u00abstato legittimo dell\u2019immobile\u00bb, ancorandolo al titolo edilizio originario, oppure a una serie di dati, in particolare per gli immobili realizzati in epoca nella quale non era obbligatorio dotarsi di un titolo edilizio (1967 per le aree esterne ai centri abitati; 1942 per i centri urbani). Secondo l\u2019articolo 6, lo stato legittimo \u00e8 quello desumibile da informazioni catastali di primo impianto (fine 1800) ovvero da \u00abaltri documenti probanti\u00bb quali le riprese fotografiche, gli estratti cartografici, i documenti di archivio ed ogni altro atto pubblico privato di cui si dimostrati la provenienza.<\/p>\n<p>&nbsp;<\/p>\n<p>Basta quindi un principio di prova della sussistenza di un titolo abilitativo, anche se non \u00e8 disponibile il relativo documento. Tutto ci\u00f2 agevoler\u00e0 la circolazione dei beni, in particolare quando, fruendo dei vari bonus, vi saranno numerosi edifici realizzati sostituendo precedenti costruzioni. Da un lato infatti \u00e8 possibile dimostrare la consistenza di un rudere prima di un intervento di ricostruzione, ricorrendo a prove anche indirette (come una descrizione in una divisione testamentaria), dall\u2019altro sar\u00e0 possibile dimostrare la legittimit\u00e0 di una ricostruzione che, seppur con modifiche, faccia capo a un nucleo edilizio legittimamente iniziato o originariamente assistito da un titolo valido seppur limitato a un\u2019altezza inferiore.<\/p>\n<p>&nbsp;<\/p>\n<script>\nvar
