L\u2019articolo 1, comma 599, della legge di bilancio 2021 (legge 178\/2020) conferma, seppure in parte, la disciplina di favore dettata dalla normativa emergenziale in materia di Imu. A questa, si aggiunge l\u2019esenzione gi\u00e0 disposta dall\u2019articolo 78 del Dl 104\/2020, per gli anni 2021 e 2022, con riferimento alle unit\u00e0 destinate a cinema e teatri.<\/p>\n<p>&nbsp;<\/p>\n<p>La legge di Bilancio 2021 ha in particolare stabilito l\u2019esonero dal pagamento di giugno con riferimento alle seguenti fattispecie: a) immobili adibiti a stabilimenti balneari marittimi, lacuali e fluviali, nonch\u00e9 immobili degli stabilimenti termali; b) immobili rientranti nella categoria catastale D\/2 (alberghi e pensioni) e relative pertinenze, immobili degli agriturismi, dei villaggi turistici, degli ostelli della giovent\u00f9, dei rifugi di montagna, delle colonie marine e montane, degli affittacamere per brevi soggiorni, delle case e appartamenti per vacanze, dei bed and breakfast, dei residence e dei campeggi; c) immobili rientranti nella categoria catastale D in uso da parte di imprese esercenti attivit\u00e0 di allestimenti di strutture espositive nell\u2019ambito di eventi fieristici o manifestazioni; d) immobili destinati a discoteche, sale da ballo, night club e simili.<\/p>\n<p>&nbsp;<\/p>\n<p>Con eccezione degli immobili di cui alle lettere a) e c), per tutte le altre ipotesi l\u2019esonero deve rispettare la regola secondo cui il gestore deve coincidere con il soggetto passivo del tributo. Questa precisazione consente pertanto di applicare l\u2019agevolazione anche nei casi in cui il soggetto che esercita l\u2019attivit\u00e0 non \u00e8 il proprietario dell\u2019immobile. Si pensi, ad esempio, al gestore di un albergo detenuto in leasing.<\/p>\n<p>&nbsp;<\/p>\n<p>Con riferimento alle attivit\u00e0 di bed &amp; breakfast e di affittacamere, le Faq pubblicate sul sito del dipartimento delle Politiche fiscali precisano che l\u2019attivit\u00e0 deve essere svolta in forma imprenditoriale, anche se questo non \u00e8 imposto dalla normativa in materia.<\/p>\n<p>&nbsp;<\/p>\n<p>Le esenzioni della legge di bilancio sono subordinate al rispetto della disciplina unionale in materia di aiuti di Stato per affrontare la situazione di emergenza da Covid-19.<\/p>\n<p>&nbsp;<\/p>\n<p>Alle misure della manovra 2021 si aggiungono quelle dell\u2019articolo 78 del Dl 104\/2020. In forza di tale previsione, gli immobili rientranti nella categoria catastale D\/3 destinati a spettacoli cinematografici, teatri e sale per concerti e spettacoli, sono esenti per le intere annualit\u00e0 2021 e 2022, a condizione che i gestori siano anche i soggetti passivi d\u2019imposta. L\u2019agevolazione \u00e8 peraltro soggetta all\u2019autorizzazione della Commissione Ue.<\/p>\n<p>&nbsp;<\/p>\n<p>La regola \u00e8 che l\u2019esonero prescinda dalla categoria catastale ma sia condizionato alla destinazione d\u2019uso dell\u2019unit\u00e0 immobiliare.<\/p>\n<p>&nbsp;<\/p>\n<p>Fanno eccezione: 1) gli alberghi e pensioni che devono ricadere nella categoria catastale D2; 2) le unit\u00e0 fieristiche che devono appartenere alla categoria catastale D; 3) i cinema e teatri che devono essere classificati nella categoria D3.<\/p>\n<p>&nbsp;<\/p>\n<script>\nvar
