Si tratta della norma contenuta nel\u00a0comma 595 dell\u2019articolo 1, della legge 178\/2020\u00a0la quale introduce la limitazione all\u2019applicazione della cedolare secca in caso di destinazione alla locazione breve di non pi\u00f9 di quattro appartamenti. In presenza di un numero superiore di appartamenti l\u2019attivit\u00e0 di locazione si presume svolta in forma di impresa.<\/p>\n<p>&nbsp;<\/p>\n<p>La locazione breve consiste nella locazione di immobili a uso abitativo della durata non superiore a 30 giorni tassabile mediante opzione nella cedolare secca (articolo 4 del Dl 50\/2017). Anzi c\u2019\u00e8 anche una semplificazione per i proprietari, che qualora nella stipula del contratto e nella riscossione del canone intervenga un intermediario, questi \u00e8 tenuto ad applicare una ritenuta del 21% e con questo il locatore assolve il debito d\u2019imposta. La cedolare secca la pu\u00f2 applicare anche il comodatario oppure il locatario che concede il fabbricato in sub locazione ed anche questi soggetti possono applicare la cedolare secca in alternativa ai redditi diversi.<\/p>\n<p>&nbsp;<\/p>\n<p>Quindi in presenza di un contribuente con pi\u00f9 di quattro appartamenti destinati alla locazione breve scattano le regole fiscali previste per i soggetti che rientrano nel reddito di impresa. Ai fini Iva la locazione di fabbricati abitativi rientra fra le operazioni esenti di cui all\u2019articolo 10, punto 8, del Dpr 633\/72\u00a0e il contribuente pu\u00f2 chiedere la dispensa degli adempimenti in base all\u2019articolo 36-bis\u00a0eliminando fatture e registro fatture emesse e dichiarazione annuale Iva. Ai fini delle imposte dirette ancorch\u00e9 il titolare sia una persona fisica, l\u2019attivit\u00e0 rientra nel reddito di impresa e precisamente nell\u2019articolo 90 del Tuir. In sostanza il reddito di impresa si determina secondo le regole catastali assumendo i ricavi risultanti dal contratto, deducendo eventualmente le spese ordinarie fini al 15% del canone e gli interessi passivi di finanziamento, ma escludendo la deduzione di tutti gli altri costi.<\/p>\n<p>&nbsp;<\/p>\n<p>Alla luce di quanto sopra per i soggetti che possiedono pi\u00f9 di quattro appartamenti destinati alla locazione breve, se non hanno cause ostative per l\u2019applicazione del regime forfettario questa norma \u00e8 un affare. Supponiamo ad esempio un contribuente che percepisce 30mila euro annu\u00ec di locazioni brevi, con la cedolare secca pagava imposta per 6.300 euro mentre nel regime forfettario per i primi cinque
