In questo solco si muove la legge di conversione del decreto Sostegni, che ha mantenuto inalterata (articolo 17) la possibilit\u00e0 per le imprese di rinnovare o prorogare per un periodo massimo di 12 mesi e per una sola volta i contratti a termine senza dover applicare le rigidissime causali previste dall\u2019articolo 19, comma 1, del D.lgs 81\/2015 dopo i primi 12 mesi del rapporto a termine (o in sede di primo rinnovo, se il contratto iniziale ha durata inferiore). Resta ferma la durata massima complessiva di 24 mesi del rapporto a tempo determinato.<\/p>\n<p>&nbsp;<\/p>\n<p>Infine, e\u0300 confermato che proroga e rinnovo debbano intervenire entro il 31 dicembre 2021. Quest\u2019ultimo passaggio, in virt\u00f9 di un precedente chiarimento dell\u2019Ispettorato nazionale del lavoro (Inl), va letto nel senso che entro la data finale vanno formalizzati il rinnovo o la proroga, mentre l\u2019esecuzione del contratto potr\u00e0 protrarsi oltre tale data.<\/p>\n<p>&nbsp;<\/p>\n<p>La legge di conversione conferma che non si deve tenere conto dei rinnovi e delle proroghe gi\u00e0 utilizzati per effetto dei precedenti interventi emergenziali. E\u0300 un passaggio significativo, perch\u00e9 consente alle imprese, che abbiano gi\u00e0 usufruito di questa misura, di azzerare il contatore e stipulare un ulteriore contratto a termine (rinnovo) o una nuova proroga, sempre nei limiti dei 12 mesi di durata nell\u2019ambito di un rapporto che complessivamente non dovr\u00e0 superare i 24 mesi.<\/p>\n<p>&nbsp;<\/p>\n<p>Possono ricorrere ai contratti a termine, in deroga alla regola ordinaria, anche le imprese che usufruiscono della Cig per gestire una fase di sospensione o riduzione dell\u2019attivit\u00e0. La previsione sull\u2019utilizzo del tempo determinato (anche a scopo di somministrazione) per lo svolgimento di mansioni in merito alle quali e\u0300 in atto il ricorso agli ammortizzatori sociali per Covid-19 e\u0300 stata introdotta con la legge di conversione del decreto Cura Italia (articolo 19-bis). L\u2019Inl ha confermato che le previsioni dell\u2019articolo 19-bis devono considerarsi tuttora pienamente operative come \u201cnorma interpretativa\u201d delle disposizioni emergenziali, le quali hanno prorogato, volta per volta, la fruizione dei trattamenti di integrazione salariale.<\/p>\n<p>&nbsp;<\/p>\n<p>Ne\u0301 va dimenticato che lo stesso Ispettorato aveva in precedenza affermato che, al regime emergenziale delle proroghe le imprese, possono accedere anche se sono state consumate le quattro proroghe massime previste dalla norma ordinaria e senza dover osservare l\u2019intervallo
