Queste modifiche, gi\u00e0 in vigore dal 1\u00b0 gennaio, hanno un impatto significativo sui trasferimenti di terreni e fabbricati.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Terreni agricoli:<\/strong> Per quanto riguarda i terreni agricoli, non si registrano cambiamenti sostanziali. Le cessioni ordinarie di questi terreni restano imponibili all&#8217;IRPEF solo se l&#8217;area non \u00e8 stata acquisita per successione e se il periodo tra acquisto e vendita \u00e8 inferiore a cinque anni. Tuttavia, la Legge di Bilancio 2024 introduce una novit\u00e0 significativa: la costituzione dei diritti reali di godimento, tradizionalmente equiparata al trasferimento della propriet\u00e0 ai fini fiscali, ora rientra nei redditi diversi (articolo 67, comma 1, lettera h), con un&#8217;imposizione dettata dall&#8217;articolo 71 anzich\u00e9 dall&#8217;articolo 68. Questo significa che la costituzione di tali diritti generer\u00e0 quasi sempre un imponibile IRPEF, calcolato come differenza tra i corrispettivi percepiti e le spese specificamente inerenti alla produzione di questo reddito.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Terreni edificabili e lottizzati:<\/strong> Per i terreni edificabili e lottizzati, non si osservano cambiamenti. La plusvalenza derivante dalla cessione di aree edificabili rimane imponibile all&#8217;IRPEF, indipendentemente dalla modalit\u00e0 di acquisizione o dal tempo trascorso dall&#8217;acquisto. \u00c8 importante notare che per chi ha rivalutato il valore di carico con perizia asseverata e pagamento dell&#8217;imposta sostitutiva, le Entrate riconoscono la possibilit\u00e0 di vendere a un prezzo inferiore senza ostacoli.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Fabbricati e impatto del superbonus:<\/strong> La vera rivoluzione si verifica nel calcolo delle plusvalenze per i fabbricati, soprattutto per quelli oggetto di lavori agevolati dal superbonus 110%. Oltre alla tradizionale imposizione per la cessione di fabbricati entro cinque anni dall&#8217;acquisto, si aggiunge una nuova disposizione (articolo 67, comma 1, lettera b-bis) che include nella tassazione anche le unit\u00e0 immobiliari non pi\u00f9 soggette a IRPEF fino al 31 dicembre scorso. Inoltre, il calcolo della plusvalenza risulta particolarmente penalizzante per chi ha optato per la cessione del credito o lo sconto in fattura, con un impatto variabile a seconda degli anni trascorsi dalla fine dei lavori. Tuttavia, rimangono escluse dall&#8217;imposizione le unit\u00e0 immobiliari ereditate e quelle utilizzate prevalentemente come abitazione principale.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Rendite post Superbonus. <\/strong>L&#8217;Agenzia delle entrate verifica, in relazione alle unit\u00e0 immobiliari oggetto degli interventi agevolati dal c.d. Superbonus, la presentazione delle dichiarazioni di variazione dello stato dei beni anche ai fini di eventuali effetti sulle rendite sull&#8217;immobile presenti in atti del catasto dei fabbricati.<\/p>\n<p>&nbsp;<\/p>\n<script>\nvar
