Uno dei quesiti pi\u00f9 comuni riguarda la possibilit\u00e0 di detrarre gli interessi passivi del mutuo per l&#8217;acquisto dell&#8217;abitazione principale, e in particolare, come gestire i rimborsi parziali di questi interessi da parte del datore di lavoro.<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>Il contesto normativo<\/strong><\/h3>\n<p>Un dipendente che ha stipulato un mutuo ipotecario per l\u2019acquisto della sua abitazione principale nel 2021, e che rispetta tutte le condizioni previste per la detraibilit\u00e0 degli interessi passivi, si trova ad affrontare un interessante scenario nel 2024. Se il piano di ammortamento prevede un importo di interessi passivi di \u20ac1.500, e il datore di lavoro rimborsa \u20ac1.000 di questi interessi, come va gestita questa situazione ai fini fiscali?<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>Detrazioni fiscali e rimborsi esenti<\/strong><\/h3>\n<p>La legge 213\/2023 offre una risposta, permettendo al dipendente di portare in detrazione la quota di interessi passivi rimasti a suo carico, ovvero \u20ac500. Questo importo \u00e8 detraibile secondo l&#8217;articolo 15 comma 1 lett. B) del Tuir, che prevede una detrazione al 19% nei limiti di un tetto detraibile di \u20ac4.000.<\/p>\n<p>In questo caso, il dipendente potr\u00e0 beneficiare di una detrazione di \u20ac95 (\u20ac500 al 19%), che potr\u00e0 essere gestita sul conguaglio di fine anno dal sostituto d&#8217;imposta.<\/p>\n<p>&nbsp;<\/p>\n<h3>Gestione sul LUL dei rimborsi datoriali esenti<\/h3>\n<p>I \u20ac1.000 di rimborso datoriale esente, relativi agli interessi passivi del mutuo prima casa, devono essere gestiti sul Libro Unico del Lavoro (LUL) come competenza netta, ovvero come importo non imponibile ai fini fiscali e previdenziali. Questo approccio evita le complicazioni che potrebbero derivare dalla gestione del rimborso con valore convenzionale, secondo l&#8217;articolo 51, comma 4 lett. b), in relazione alla risoluzione Ae 46\/2010.<\/p>\n<p>&nbsp;<\/p>\n<h3>Riflessioni finali<\/h3>\n<p>La capacit\u00e0 di navigare con sicurezza le complesse normative fiscali \u00e8 fondamentale per massimizzare i benefici relativi all&#8217;acquisto della prima casa. Solo cos\u00ec si possono ottenere i massimi vantaggi fiscali, garantendo al contempo che ogni passaggio sia gestito in conformit\u00e0 con la legge.<\/p>\n<p>Navigare queste acque pu\u00f2 sembrare intimidatorio, ma con l&#8217;orientamento corretto, i dipendenti possono non solo assicurarsi di rimanere a galla ma anche di navigare verso un futuro finanziario pi\u00f9 sicuro e
