Questo intervento rientra nel piano nazionale per sostenere la genitorialit\u00e0 e conciliare i tempi di vita e lavoro, in particolare nei primi anni di vita del figlio.<\/p>\n<p data-start=\"504\" data-end=\"756\">Una novit\u00e0 importante, che merita attenzione soprattutto alla luce dei casi particolari, come quelli legati all\u2019interdizione post partum. Analizziamo un caso concreto che ha sollevato dubbi interpretativi e vediamo le indicazioni ufficiali disponibili.<\/p>\n<p data-start=\"758\" data-end=\"822\"><strong data-start=\"758\" data-end=\"822\">Il caso specifico: interdizione oltre i cinque mesi canonici<\/strong><\/p>\n<p data-start=\"824\" data-end=\"1246\">Una lavoratrice madre, dipendente in un\u2019azienda che applica il CCNL delle Cooperative Sociali, ha usufruito di un periodo di astensione obbligatoria post partum fino al 12 febbraio 2025. Questo prolungamento oltre i cinque mesi ordinari di congedo di maternit\u00e0 (conclusi il 12 ottobre 2024) \u00e8 stato disposto dall\u2019Ispettorato Territoriale del Lavoro (ITL), in base a condizioni mediche che ne giustificavano l\u2019interdizione.<\/p>\n<p data-start=\"1248\" data-end=\"1359\"><strong data-start=\"1248\" data-end=\"1359\">Domanda: ha diritto al terzo mese di congedo parentale indennizzato all\u201980% previsto dalla nuova normativa?<\/strong><\/p>\n<p data-start=\"1361\" data-end=\"1413\"><strong data-start=\"1361\" data-end=\"1413\">La risposta: s\u00ec, se il congedo \u00e8 fruito nel 2025<\/strong><\/p>\n<p data-start=\"1415\" data-end=\"1782\">La risposta \u00e8 positiva. L\u2019interpretazione corretta si fonda su quanto stabilito nella circolare INPS n. 57 del 18 aprile 2024. Sebbene riferita all\u2019annualit\u00e0 precedente, la ratio normativa e le modalit\u00e0 applicative rimangono identiche: il diritto all\u2019indennit\u00e0 maggiorata del congedo parentale \u00e8 legato alla data di conclusione effettiva dell\u2019astensione obbligatoria.<\/p>\n<p data-start=\"1784\" data-end=\"2194\">Come specificato nella circolare, il diritto all\u2019indennizzo all\u201980% per i mesi aggiuntivi \u00e8 riconosciuto anche se il periodo di maternit\u00e0 termina dopo il 31 dicembre (2022, 2023 e ora 2024) per effetto di un provvedimento interdittivo post partum. Di conseguenza, la lavoratrice in questione, il cui periodo di interdizione \u00e8 terminato nel 2025, rientra pienamente nel perimetro applicativo della nuova misura.<\/p>\n<p data-start=\"2196\" data-end=\"2236\"><strong data-start=\"2196\" data-end=\"2236\">Le condizioni generali da rispettare<\/strong><\/p>\n<p data-start=\"2238\" data-end=\"2359\">Per fruire del terzo mese di congedo parentale con l\u2019indennit\u00e0 all\u201980%, devono essere soddisfatte le seguenti condizioni:<\/p>\n<ul data-start=\"2361\" data-end=\"2678\">\n<li data-start=\"2361\" data-end=\"2423\">\n<p data-start=\"2363\" data-end=\"2423\">il congedo deve essere fruito a partire dal 1\u00b0 gennaio 2025;<\/p>\n<\/li>\n<li data-start=\"2424\" data-end=\"2561\">\n<p data-start=\"2426\" data-end=\"2561\">il figlio deve avere meno di sei anni o, in caso di adozione\/affidamento, l\u2019ingresso in famiglia deve essere avvenuto entro i sei anni;<\/p>\n<\/li>\n<li data-start=\"2562\" data-end=\"2678\">\n<p data-start=\"2564\" data-end=\"2678\">il periodo di maternit\u00e0 o paternit\u00e0 (comprensivo di eventuali proroghe) deve concludersi dopo il 31 dicembre 2024.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2680\" data-end=\"2699\"><strong data-start=\"2680\" data-end=\"2699\">Esempio pratico<\/strong><\/p>\n<p data-start=\"2701\" data-end=\"3047\">Una madre rientra da un periodo di interdizione post partum il 12 febbraio 2025. Decide di fruire di tre mesi di congedo parentale consecutivi, iniziando il 1\u00b0 marzo 2025. Avr\u00e0 diritto all\u2019indennizzo dell\u201980% per tutti e tre i mesi, a condizione che ne faccia regolare domanda all\u2019INPS, tramite i canali online dedicati, entro i termini previsti.<\/p>\n<p data-start=\"3049\" data-end=\"3090\"><strong data-start=\"3049\" data-end=\"3090\">Implicazioni per aziende e lavoratori<\/strong><\/p>\n<p data-start=\"3092\" data-end=\"3364\">Per i datori di lavoro, \u00e8 essenziale aggiornare le procedure interne di gestione delle assenze parentali per recepire correttamente le novit\u00e0 normative. Errori nella comunicazione o nella gestione dell\u2019indennit\u00e0 possono comportare contenziosi o contestazioni contributive.<\/p>\n<p data-start=\"3366\" data-end=\"3617\">Per i lavoratori,
