{"id":20363,"date":"2025-08-16T20:22:27","date_gmt":"2025-08-16T18:22:27","guid":{"rendered":"https:\/\/beneggiassociati.com\/?p=20363"},"modified":"2025-08-16T20:22:27","modified_gmt":"2025-08-16T18:22:27","slug":"contratti-a-termine-oltre-i-12-mesi-anche-nel-2026-si-potranno-indicare-le-causali-individualmente","status":"publish","type":"post","link":"https:\/\/beneggiassociati.com\/en\/contratti-a-termine-oltre-i-12-mesi-anche-nel-2026-si-potranno-indicare-le-causali-individualmente\/","title":{"rendered":"Contratti a termine oltre i 12 mesi: anche nel 2026 si potranno indicare le causali individualmente"},"content":{"rendered":"<h2 data-start=\"176\" data-end=\"278\"><\/h2>\n<p data-start=\"280\" data-end=\"746\">Con la <strong data-start=\"287\" data-end=\"326\">legge di conversione del Dl 95\/2025<\/strong>, il legislatore ha prorogato fino al <strong data-start=\"364\" data-end=\"384\">31 dicembre 2026<\/strong> la possibilit\u00e0, per le parti individuali, di <strong data-start=\"430\" data-end=\"467\">inserire autonomamente le causali<\/strong> che legittimano l\u2019estensione dei contratti a termine oltre i 12 mesi, anche in somministrazione. Una proroga che, in realt\u00e0, conferma l\u2019incapacit\u00e0 sistemica della contrattazione collettiva di coprire in tempi utili uno snodo operativo fondamentale per la gestione del personale.<\/p>\n<p data-start=\"748\" data-end=\"999\">Per imprese e datori di lavoro si tratta di un\u2019estensione pratica e strategica, che evita il blocco dei contratti in essere e consente di gestire in continuit\u00e0 le esigenze produttive, organizzative e tecniche, anche in assenza di un accordo sindacale.<\/p>\n<h3 data-start=\"1001\" data-end=\"1048\">Quadro normativo: cosa dice il Dlgs 81\/2015<\/h3>\n<p data-start=\"1050\" data-end=\"1091\">In base all\u2019articolo 19 del Dlgs 81\/2015:<\/p>\n<ul data-start=\"1092\" data-end=\"1335\">\n<li data-start=\"1092\" data-end=\"1240\">\n<p data-start=\"1094\" data-end=\"1240\">i contratti a termine (compresi quelli in somministrazione) <strong data-start=\"1154\" data-end=\"1209\">possono essere stipulati liberamente fino a 12 mesi<\/strong>, senza obbligo di motivazione;<\/p>\n<\/li>\n<li data-start=\"1241\" data-end=\"1335\">\n<p data-start=\"1243\" data-end=\"1335\">oltre i 12 mesi, il contratto pu\u00f2 proseguire solo in presenza di <strong data-start=\"1308\" data-end=\"1334\">causali giustificative<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1337\" data-end=\"1450\">La riforma operata dal <strong data-start=\"1360\" data-end=\"1374\">Dl 48\/2023<\/strong>, convertito con legge 85\/2023, ha previsto che tali causali debbano essere:<\/p>\n<ul data-start=\"1451\" data-end=\"1742\">\n<li data-start=\"1451\" data-end=\"1604\">\n<p data-start=\"1453\" data-end=\"1604\">individuate da <strong data-start=\"1468\" data-end=\"1528\">contratti collettivi nazionali, territoriali o aziendali<\/strong> stipulati da organizzazioni sindacali comparativamente pi\u00f9 rappresentative;<\/p>\n<\/li>\n<li data-start=\"1605\" data-end=\"1742\">\n<p data-start=\"1607\" data-end=\"1742\">o, <strong data-start=\"1610\" data-end=\"1646\">in assenza di accordi collettivi<\/strong>, indicate <strong data-start=\"1657\" data-end=\"1697\">direttamente dalle parti individuali<\/strong>, come previsto dalla disciplina transitoria.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"1744\" data-end=\"1795\">La proroga: una transizione che diventa sistema<\/h3>\n<p data-start=\"1797\" data-end=\"1848\">Quella del 2026 \u00e8 la <strong data-start=\"1818\" data-end=\"1847\">terza proroga consecutiva<\/strong>:<\/p>\n<ul data-start=\"1849\" data-end=\"2073\">\n<li data-start=\"1849\" data-end=\"1895\">\n<p data-start=\"1851\" data-end=\"1895\">prima scadenza: 30 aprile 2024 (Dl 48\/2023);<\/p>\n<\/li>\n<li data-start=\"1896\" data-end=\"1947\">\n<p data-start=\"1898\" data-end=\"1947\">prima proroga: 31 dicembre 2024 (legge 191\/2023);<\/p>\n<\/li>\n<li data-start=\"1948\" data-end=\"2000\">\n<p data-start=\"1950\" data-end=\"2000\">seconda proroga: 31 dicembre 2025 (legge 56\/2024);<\/p>\n<\/li>\n<li data-start=\"2001\" data-end=\"2073\">\n<p data-start=\"2003\" data-end=\"2073\">terza proroga: 31 dicembre 2026 (legge di conversione del Dl 95\/2025).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2075\" data-end=\"2393\">In assenza di contrattazione collettiva, la norma consente alle parti di continuare a stipulare contratti a termine oltre i 12 mesi <strong data-start=\"2207\" data-end=\"2306\">indicando nel contratto individuale le \u201cesigenze di natura tecnica, organizzativa o produttiva\u201d<\/strong>. Queste causali vanno redatte in forma dettagliata e congruente con l\u2019attivit\u00e0 svolta.<\/p>\n<h3 data-start=\"2395\" data-end=\"2440\">Esempi concreti: due casi di applicazione<\/h3>\n<p data-start=\"2442\" data-end=\"2906\"><strong data-start=\"2442\" data-end=\"2504\">1. Azienda metalmeccanica in fase di reindustrializzazione<\/strong><br data-start=\"2504\" data-end=\"2507\" \/>Un\u2019impresa impegnata nel rilancio di un sito produttivo ha necessit\u00e0 di mantenere personale tecnico per oltre 12 mesi, in attesa di confermare l\u2019organico definitivo. Non essendo ancora intervenuto un contratto aziendale che disciplini i \u201ccasi\u201d, l\u2019azienda utilizza la possibilit\u00e0 di inserire una causale individuale che espliciti il bisogno di continuit\u00e0 tecnica nella fase di transizione produttiva.<\/p>\n<p data-start=\"2908\" data-end=\"3338\"><strong data-start=\"2908\" data-end=\"2961\">2. Societ\u00e0 di servizi IT con contratti a progetto<\/strong><br data-start=\"2961\" data-end=\"2964\" \/>Una societ\u00e0 che opera su progetti specifici, con scadenze di lungo periodo, proroga un contratto a termine oltre i 12 mesi indicando, nel contratto individuale, una causale che esplicita la necessit\u00e0 di continuit\u00e0 su un progetto in fase di deployment per un cliente strategico. Anche in questo caso, la mancanza di accordi collettivi non blocca la prosecuzione del rapporto.<\/p>\n<h3 data-start=\"3340\" data-end=\"3396\">Un vuoto strutturale che diventa strumento operativo<\/h3>\n<p data-start=\"3398\" data-end=\"3632\">Di fatto, la norma transitoria si \u00e8 trasformata in <strong data-start=\"3449\" data-end=\"3470\">regola di sistema<\/strong>. La difficolt\u00e0, spesso insormontabile, di ottenere intese sindacali puntuali e tempestive ha reso l\u2019autonomia contrattuale <strong data-start=\"3594\" data-end=\"3631\">non solo utile, ma indispensabile<\/strong>.<\/p>\n<p data-start=\"3634\" data-end=\"3997\">Il problema risiede nell\u2019instabilit\u00e0 normativa: proroghe annuali non consentono una pianificazione a lungo termine. Per questo motivo \u00e8 auspicabile una riforma strutturale che <strong data-start=\"3810\" data-end=\"3868\">stabilizzi la possibilit\u00e0 di usare causali individuali<\/strong> o, in alternativa, obblighi il sistema collettivo a produrre strumenti applicabili nei tempi congrui con le dinamiche aziendali.<\/p>\n<h3 data-start=\"3999\" data-end=\"4049\"><\/h3>\n<p data-start=\"4051\" data-end=\"4344\">La redazione corretta delle <strong data-start=\"4079\" data-end=\"4102\">causali individuali<\/strong> richiede competenze giuridiche e una lettura strategica dei fabbisogni organizzativi. Una formula generica o non coerente pu\u00f2 essere impugnata e trasformare un contratto a termine in <strong data-start=\"4286\" data-end=\"4343\">contratto a tempo indeterminato per effetto
