Si tratta di una risposta normativa attesa da tempo, destinata ad avere un impatto rilevante sull\u2019organizzazione delle imprese e sulla gestione amministrativa dei rapporti di lavoro.<\/p>\n<p data-start=\"599\" data-end=\"951\">La riforma riconosce il diritto a periodi di <strong data-start=\"644\" data-end=\"685\">congedo non retribuito fino a 24 mesi<\/strong>, permessi aggiuntivi per cure mediche e priorit\u00e0 nell\u2019accesso al lavoro agile. Una disciplina che supera, ove meno favorevoli, anche le previsioni dei contratti collettivi, imponendo agli uffici HR e ai consulenti un immediato adeguamento delle procedure interne.<\/p>\n<h3 data-start=\"953\" data-end=\"979\">Congedo fino a 24 mesi<\/h3>\n<p data-start=\"981\" data-end=\"1245\">L\u2019articolo 1 della legge prevede che i dipendenti pubblici e privati, affetti da malattie oncologiche, croniche o invalidanti con grado di invalidit\u00e0 pari o superiore al 74%, possano richiedere un <strong data-start=\"1178\" data-end=\"1215\">periodo di congedo fino a 24 mesi<\/strong>, continuativo o frazionato.<\/p>\n<p data-start=\"1247\" data-end=\"1276\">Caratteristiche principali:<\/p>\n<ul data-start=\"1277\" data-end=\"1600\">\n<li data-start=\"1277\" data-end=\"1313\">\n<p data-start=\"1279\" data-end=\"1313\">il congedo <strong data-start=\"1290\" data-end=\"1310\">non \u00e8 retribuito<\/strong>;<\/p>\n<\/li>\n<li data-start=\"1314\" data-end=\"1400\">\n<p data-start=\"1316\" data-end=\"1400\">durante il periodo, il lavoratore <strong data-start=\"1350\" data-end=\"1397\">non pu\u00f2 svolgere alcuna attivit\u00e0 lavorativa<\/strong>;<\/p>\n<\/li>\n<li data-start=\"1401\" data-end=\"1481\">\n<p data-start=\"1403\" data-end=\"1481\">\u00e8 necessaria una <strong data-start=\"1420\" data-end=\"1445\">certificazione medica<\/strong> del medico di base o specialista;<\/p>\n<\/li>\n<li data-start=\"1482\" data-end=\"1600\">\n<p data-start=\"1484\" data-end=\"1600\">il periodo non \u00e8 coperto da contribuzione figurativa, ma pu\u00f2 essere <strong data-start=\"1552\" data-end=\"1566\">riscattato<\/strong> mediante versamento volontario.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1602\" data-end=\"1890\">Questo punto rappresenta una criticit\u00e0: l\u2019assenza di contribuzione figurativa penalizza il lavoratore sotto il profilo previdenziale. Alcuni ordini del giorno parlamentari hanno impegnato il Governo a rivedere la norma, ma al momento resta il versamento volontario come unica soluzione.<\/p>\n<p data-start=\"1892\" data-end=\"2097\">Per i <strong data-start=\"1898\" data-end=\"1921\">lavoratori autonomi<\/strong>, la legge prevede la possibilit\u00e0 di sospendere, per un massimo di 300 giorni l\u2019anno, le prestazioni continuative per un committente. Anche in questo caso senza retribuzione.<\/p>\n<h3 data-start=\"2099\" data-end=\"2138\">Accesso prioritario al lavoro agile<\/h3>\n<p data-start=\"2140\" data-end=\"2500\">Terminato il periodo di congedo, il lavoratore malato ha diritto a una <strong data-start=\"2211\" data-end=\"2255\">corsia preferenziale per il lavoro agile<\/strong>, a condizione che la mansione sia compatibile con la modalit\u00e0 da remoto.<br data-start=\"2328\" data-end=\"2331\" \/>Questa previsione si aggiunge ai criteri gi\u00e0 esistenti, rafforzando il quadro di tutela e introducendo per le aziende un ulteriore vincolo organizzativo da rispettare.<\/p>\n<h3 data-start=\"2502\" data-end=\"2544\">Permessi aggiuntivi dal 1\u00b0 luglio 2026<\/h3>\n<p data-start=\"2546\" data-end=\"2723\">Dal <strong data-start=\"2550\" data-end=\"2568\">1\u00b0 luglio 2026<\/strong> i lavoratori interessati avranno diritto a <strong data-start=\"2612\" data-end=\"2651\">10 ore annue di permesso aggiuntivo<\/strong> (oltre a quelli previsti dalla legge o dal contratto collettivo) per:<\/p>\n<ul data-start=\"2724\" data-end=\"2804\">\n<li data-start=\"2724\" data-end=\"2743\">\n<p data-start=\"2726\" data-end=\"2743\">visite mediche,<\/p>\n<\/li>\n<li data-start=\"2744\" data-end=\"2776\">\n<p data-start=\"2746\" data-end=\"2776\">esami clinici e diagnostici,<\/p>\n<\/li>\n<li data-start=\"2777\" data-end=\"2804\">\n<p data-start=\"2779\" data-end=\"2804\">cure mediche frequenti.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2806\" data-end=\"3044\">I permessi sono riconosciuti anche ai lavoratori con figli minori affetti dalle stesse patologie.<br data-start=\"2903\" data-end=\"2906\" \/>\u00c8 richiesta la <strong data-start=\"2921\" data-end=\"2944\">prescrizione medica<\/strong> rilasciata dal medico di base o da uno specialista di una struttura sanitaria pubblica o privata.<\/p>\n<p data-start=\"3046\" data-end=\"3397\">L\u2019indennit\u00e0 economica collegata a tali permessi \u00e8 parametrata alle regole vigenti in materia di malattia. Tuttavia, la formulazione della norma appare poco chiara, poich\u00e9 la disciplina della malattia varia in base alla categoria del lavoratore, alla durata dell\u2019assenza e al tipo di trattamento sanitario. Sono attesi chiarimenti da parte dell\u2019Inps.<\/p>\n<h3 data-start=\"3399\" data-end=\"3440\">Implicazioni per imprese e lavoratori<\/h3>\n<p data-start=\"3442\" data-end=\"3503\">Le nuove tutele comportano conseguenze operative rilevanti:<\/p>\n<ul data-start=\"3504\" data-end=\"3930\">\n<li data-start=\"3504\" data-end=\"3621\">\n<p data-start=\"3506\" data-end=\"3621\"><strong data-start=\"3506\" data-end=\"3524\">per le aziende<\/strong>: necessit\u00e0 di aggiornare regolamenti interni, policy HR e procedure di gestione delle assenze;<\/p>\n<\/li>\n<li data-start=\"3622\" data-end=\"3755\">\n<p data-start=\"3624\" data-end=\"3755\"><strong data-start=\"3624\" data-end=\"3644\">per i lavoratori<\/strong>: possibilit\u00e0 di pianificare percorsi terapeutici con maggiori garanzie di conservazione del posto di lavoro;<\/p>\n<\/li>\n<li data-start=\"3756\" data-end=\"3930\">\n<p data-start=\"3758\" data-end=\"3930\"><strong data-start=\"3758\" data-end=\"3782\">per gli uffici paghe<\/strong>: adeguamenti immediati a partire dal 9 agosto 2025, con necessit\u00e0 di distinguere le assenze da malattia ordinaria e quelle da congedo oncologico.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"3932\" data-end=\"3959\"><\/h3>\n<p data-start=\"3961\" data-end=\"4225\">Per le imprese, non si tratta solo di adempiere a un obbligo di legge. La corretta applicazione delle nuove misure pu\u00f2 rappresentare anche un <strong data-start=\"4103\" data-end=\"4141\">elemento di responsabilit\u00e0 sociale<\/strong> e di valorizzazione del
